Learner Sign-up Pilot Terms of Use

The Newsela, Inc. (“Newsela”) Learner Accounts (defined below) are currently in beta testing and may be accessed by you only if you acknowledge and agree to the developmental nature of the Learner Accounts and to fully comply with the terms and conditions set forth below (the “Learner Beta Terms of Use”).

PLEASE READ THESE LEARNER BETA TERMS OF USE ALONG WITH THE TERMS OF USE AVAILABLE AT https://newsela.com/pages/terms-of-use/ (“WEBSITE TERMS OF USE”) CAREFULLY BEFORE REGISTERING FOR OR USING A LEARNER ACCOUNT. YOUR REGISTRATION FOR OR USE OF A LEARNER ACCOUNT IS GOVERNED BY THE WEBSITE TERMS OF USE, EXCEPT AS EXPRESSLY SET FORTH IN THESE LEARNER BETA TERMS OF USE (THE WEBSITE TERMS OF USE AND LEARNER BETA TERMS OF USE, TOGETHER, THE “TERMS AND CONDITIONS”). BY REGISTERING FOR OR USING A LEARNER ACCOUNT, YOU (“YOU” OR “YOUR”) AGREE TO BECOME BOUND BY THE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS, YOU MAY NOT REGISTER FOR OR USE A LEARNER ACCOUNT.

1. Services. While the Pilot Services (defined below) are in effect, “Services” as used in the Website Terms of Use will be deemed to include the provision of the platform and related services to student users that register for accounts without class codes (“Pilot Services”) on the Newsela Website through Newsela’s pilot “Learner” account registration process (each such student, a “Learner”, and each such account, a “Learner Account”). While the Pilot Services are in effect, “Students” as used in the Website Terms of Use will be deemed to include Learner, except as expressly set forth herein.

2. Eligibility; Minor Users. By registering for a Learner Account, you represent and warrant that you are at least 13 years of age. If you are under age 13, you may not register for a Learner Account and can only use the Services if a Teacher or Parent provides you with a Student Account. If you are under age 18, you may only use the Pilot Services under the supervision of an adult, in which case the adult shall be deemed the user of the Pilot Services and shall be responsible for any and all activities.

3. Termination. These Terms and Conditions, and your use of and access to the Website and Pilot Services may be terminated by either party for any reason or no reason immediately with or without notice. Upon such termination, you shall no longer have any right to access or use the Pilot Services, your Learner Account will be disabled, and you shall immediately delete any and all documents, notes, and other materials associated with the Pilot Services.

4. Scope. All terms and conditions of the Website Terms of Use shall remain unchanged except as modified in these Learner Beta Terms of Use, and the terms of the Website Terms of Use, as modified by these Learner Beta Terms of Use, are hereby ratified and confirmed. In the event of a conflict between the terms and conditions of these Learner Beta Terms of Use and the Website Terms of Use, these Learner Beta Terms of Use shall control for purposes of the Pilot Services only.
